The Delhi High Court has ruled against Google for actively suggesting trademarked brand names to advertisers through its Keyword Planner, running auctions on those terms, and earning revenue from every resulting click, in the Google vs Hindware case. Legal and marketing experts say the decision could have sweeping consequences for how digital and performance advertising operates in India.

“What this ruling essentially tells brands and marketers is that Google’s policies are not India’s policies. Just because a platform permits something doesn’t mean it’s legally safe under Indian law,” said Mihir Mehta, Co-founder, 0101.
